These General Conditions of Sale (hereinafter "GCS") apply to all purchases of Kamiorigami products (hereinafter the "Seller"), made remotely via a telematic network via the website https: //www.kamiorigami .com (hereinafter "online shop").The contractual parties are the Customer, on the one hand, and Kamiorigami, the artist Valentina Mannino, on the other, based in San Giovanni La Punta Via Balatelle 19 / a, VAT number IT 05832680879.

1. THE ORDER CREATION 

1.1 The products are sold to the Customer identified by the data entered at the time of training and sending the Order form in electronic format with simultaneous acceptance of these General Conditions of Sale.

1.2 The Customer is prohibited from entering false and / or invented and / or fictional names in the online Order procedure and in further communications.  The Seller reserves the right to legally any contract and abuse, in the interest and for the protection of all consumers.

1.3 Furthermore, by accepting these GCS, the Customer exempts the Seller from any liability deriving from the issue of incorrect tax documents due to errors in the data provided at the time of placing the Order online, being the Customer solely responsible for their correct insertion.

2. SALE BY ELECTRONIC COMMERCE SERVICE

2.1 By online sales contract we mean the distance contract concerning the sale of movable goods (hereinafter Products) stipulated between the Customer, and Kamiorigami, as Seller, in the context of an e-commerce service organized by the Seller. that, on behalf of a specific purpose, use the distance communication technology known as the Internet.

2.2 To complete the purchase multi-format contract of one of the products, the customer must complete the order form forward of the electronic order and send it to the seller through the Internet with the relative instructions.

2.3 The Order contains:

  · A reference to these General Conditions of Sale;

  · Information and images of each Product and its price;

The means of payment that you can use;

The methods of the purchased products  delivery and the relative shipping and delivery costs;

A reference to the conditions for exercising your right of withdrawal;

  · The methods and times for returning the purchased products.

2.4 The kamiorigami products are unique pieces.  The processing technique is completely handmade.  therefore, any differences with respect to the photographs (which perform an illustrative function of the good), or small imperfections, are not attributable to a manufacturing defect, but to the artisan nature of the product.

2.5 Before selling the contract, the right to confirm the Information of the General Conditions of Sale will be asked to read the withdrawal of the information and the processing of personal data.

2.6 The contract is concluded when the seller receives the Order Form sent by the Customer via the Internet, after verifying the data correctness  relating to the Order itself.

2.7 The language available for the contract with the seller is Italian and the applicable law is Italian.

2.8 Once the contract is concluded, the seller will take charge of the Order for its evasion.

3. ORDER EVASION

By transmitting the Order via the Internet, the Customer unconditionally accepts and undertakes to observe these GCS in relations with the seller.

3.1 Once the contract is concluded, the Seller will send the Customer, by e-mail, an Order Confirmation, containing an  information summary useful for the order to be successful.  The reserves the right, before sending confirmation of the Order, to request by email or by telephone, further information regarding the Order

3.2 In case of product unavailability  or product defective, the seller undertakes to inform the Customer by e-mail or by telephone that the contract is not concluded and that he has not carried out the Order specifying the reasons.  On account of the hypothesis, the sum previously committed on the Customer's means of payment will be released.

3.3 If the products, showed on the website, are no longer available or on sale after sending the Order, it will be the seller's responsibility to notify them promptly and in any case within thirty (30) working days from the day following that in which the Customer will have sent the Order to the Seller, the possible products unavailability ordered.  On account of the hypothesis, the sum previously committed on the Customer's means of payment will be released.

3.4 Kamiorigami.com reserves the right to refuse orders from a Customer with whom there is a legal dispute relating to a previous Order, or from a Customer deemed unsuitable, including, by way of example, the case of previous violations of conditions of contract for online purchase on the Site.

4. SALE PRICES

All the prices indicated are expressed in euros, inclusive of VAT at the legal rate of 0% as these unique pieces are handcrafted.  Transport costs are excluded.  It will be worth the indicator price at the time of the order.

 4.1 All products are shipped directly from Italy.  The Products prices and the shipping and delivery costs indicated on the website and in the Order, unless otherwise specified, are to be considered not including any costs related to customs duties and related if the shipment takes place in non-EU countries or in countries where current legislation provides for import charges.  These costs are therefore charged to the Customer and therefore be paid directly upon delivery of the Products, according to the specific indications in the Order Confirmation.  For shipping costs, please refer to point 6.

5. METHOD OF PAYMENT

Until full payment has been made, the goods will remain the property of Kamiorigami.

The payment of the Products price  and the relative shipping and delivery costs can be made using the methods indicated in the Order form of the website www.kamorigami.com, i.e. Stripe, Paypal, Bank transfer, postpay.  Here are the specifications.

5.1 Bank transfer

5.1.1 For online orders on our site we accept advance bank transfers.  Payment must be made no later than 5 working days following the order confirmation, otherwise the contract must be considered terminated and ineffective and the customer will receive an email canceling the Order.  The products will be shipped only after kamiorigami.com sees the credit on your current account.

5.1.2 The purpose of the transfer must indicate the following data:

  · Name and surname of the person who placed the Order

  · Order number

  · Order data

5.2 Credit cards and prepaid cards.

5.2.1 For online orders on our site we accept both credit card and prepaid card payments (for example, PostePay) through the paypal platform, without any additional charge on the product cost and shipping.  It is understood that the customer must be the holder of a valid credit card at the time of Ordering the Products purchased online and that the name on the credit card must be the same indicator on the billing data.  In the absence of these conditions, it will not be possible to proceed with the Order.

5.2.2 At the time of the online purchase, together with the Order Confirmation, the reference bank will only undertake the commitment of the amount relating to the Order from the availability of the Customer's credit card.  The amount will actually be charged to your credit card only when the purchased products are shipped.

5.2.3 If, once the package has been received with the Order, for any reason the Customer intends to make use of the right of withdrawal, following the payment of the Products purchased online, the Seller will instruct the bank to credit the amount to be refunded directly to the Customer's credit card.

5.3 PayPal.

5.3.1 If the customer has a Paypal account, kamiorigami.com gives the possibility to make payments directly using the email and relative password with which the Customer registered on www.paypal.com.

5.4 At no time during the purchase procedure is kamiorigami.com able to know the information relating to the Customer's credit card (for example, the credit card number or its expiry date), transmitted via a connection protected by an encrypted protocol. To the website of the person who directly manages the electronic payment (bank or Paypal).  No electronic archive of the seller will keep such data.  In no case can the seller be held responsible for any fraudulent and improper use of credit and prepaid cards by third parties.

6. SHIPMENTS, COSTS AND DELIVERY

6.1 Each shipment contains:

  ·  The / the products / or ordered / or;

  ·  The relative transport document / accompanying invoice;

  ·  Any accompanying documentation required based on the country of dispatch

  ·  Any information and marketing material.

6.2 The products purchased will be delivered by the courier identified by the seller to the shipping address indicated by the Customer on the Order with insured shipping.

6.3 The products are summoned, based on availability, within 7 working days.  All the items we ship are packed and protected with great care to avoid being damaged in transit.

6.4 Orders with destination Italy are delivered by courier (Nexive, Crono, Bartolini, SDA) in 1-3 working days.  Standard shipping costs 6 euros.  

For orders over 75 Euros shipping is free.

6.5 For European Union destinations, orders are delivered by UPS courier in 3 - 7 working days.

The shipment  price of the varies according to the destination as follows:

· Germany, Denmark, Belgium, Netherlands, France, Luxembourg, Principality of Monaco, Spain, Portugal, Ireland, Austria, Croatia, Finland, Northern Ireland, Slovenia, Sweden, Greece, Czech Republic, Slovakia, Poland, Hungary 12 Euros.

· Bulgaria, Estonia, Latvia, Lithuania and Romania 15 Euros.

· United Kingdom 17 Euro.

· Norway, Switzerland 29 Euro.

For international destinations, orders are delivered by UPS courier in 10-20 working days. 

The price of the shipment varies according to the destination as follows:

· United States, Canada 26 euros.

· Turkey 28 euros.

· Malta 31 euros.

· Australia, Brazil.  China, Japan 43 Euro.

· Russia 54 euros.

6.6 We ship worldwide but the prices are not fixed.

For the rest of the world , parcels are delivered in 10 - 20 working days.

6.7 The shipping cost is charged at the  payment on the total order.  The carrier is not obliged to request payments.

6.8 Kamiorigami is not responsible for any delays due to the carrier.

6.9 At the goods delivery by the courier, the buyer is required to check that the packaging is intact, not damaged, wet or otherwise altered, even in the sealing materials of the packaging (eg adhesive tape).

Any packaging damage and / or the product or the packages mismatch  must be immediately reported, by putting a written, "acceptance with reservation", specifying the reason for the reservation, on the courier's proof of delivery.  After having signed the courier's document, the buyer will not be able to make any objection about the external conditions of what has been delivered.

6.10 Any physical integrity problems, the correspondence of the products found from the communication within 5 days to the address info@kamiorigami.com

 

7. WITHDRAWAL RIGHT

7.1 Only if the Customer who enters into the contract is a Consumer (that is: any natural person who acts on the site for purposes unrelated to any business or professional activity carried out), will he have the right to withdraw from the contract concluded with the Seller, without any penalty. and without specifying the reason, within fourteen (14) working days, starting from the day of receipt of the products purchased on the website.

7.2 The return must be requested and authorized by e-mail to the following address: info@kamiorigami.com

7.3 The items  return, even in the event of a product change, is at the expense and under the responsibility of the Consumer.

The Consumer must return the goods with shipping costs charged to him, in compliance with the following provisions:

  · The returned Products must be returned in their entirety and not on parts or components of them even in the case of kits;

  · The Products returned must not have been used, worn or damaged;

  · The returned Products must be returned in their original packaging;

  · The returned Products must be invited to the seller in a single shipment.  The Seller reserves the right not to accept Products of the same Order returned and shipped at different times;

The returned products must be delivered to the courier within fourteen (14) working days from the date in which you received the products.

7.4 The withdrawal right  is exercised in accordance with the previous conditions, the customer can request a refund of all payments received from the seller, including any shipping costs of the goods incurred during the purchase.  In the event of a refund, the seller is obliged to do so no later than 30 days after the seller receives the returned products.  Normally the re-credit by kamiorigami.com of the amount initially withdrawn takes place very quickly, but the times in which the re-credit will be visible on your current account will depend on the Customer's bank.

7.5 In a return, the only costs charged to the Customer will remain those for shipping the Order of the products purchased.

7.6 In the exercising the withdrawal right without complying with the methods indicated above (eg beyond the 14 days provided), the seller will send the purchased products back to you, also charging you for the additional shipping costs.

7.7 The withdrawal right  cannot be applied in the case of customized products at the explicit request of the Customer at the time of placing the Order.

 9. TO THE CUSTOMER

   The customer acknowledges, accepts and gives his consent to the fact that all communications, notifications, attestations, information, reports and in any case any documentation on the operations performed, referring to the purchase of the Products, sent to the indicator e-mail address at the time registration, with the downloading possibility of the information on support in the ways and within the limits provided by the site.

10. APPLICABLE LAW, DISPUTE RESOLUTION AND JURISDICTION

These GCS are governed by Italian law and will be interpreted on the basis of it, without prejudice to a different prevailing imperative rule of the country of habitual residence of the Customer.  Consequently, the interpretation, execution and resolution of the GCS are subject exclusively to Italian law and any disputes inherent and / or attributed to them be resolved exclusively by the Italian judicial authority.  In particular, if the Customer qualifies as a Consumer, any disputes may be resolved by the court of the place of domicile or residence of the same according to the applicable law or, at the choice of the consumer in case of action taken by the consumer himself, by the Court of Catania.  If, on the other hand, the Customer acts in the exercise of his own business, commercial, craft or professional activity, the parties agree to establish the exclusive jurisdiction of the Court of Catania.

 11. MODIFICATION AND UPDATE

  The Seller may make changes or amendments to these GCS at any time.  Therefore, the Customer will be required to purchase only the GCS in force at the time of the relative purchase.  The new GCS will be effective from the date of publication on the website www.kamiorigami.com and in relation to purchase orders submitted after that date.

We wish to inform you that the Legislative Decree  nf.  196 of 30 June 2003 ("Code regarding the protection of personal data") provides for the protection of persons and other subjects regarding the processing of personal data.
